General Terms and Conditions (GTC)

General Terms and Conditions

1. Scope

These Terms and Conditions apply to all services offered, in particular city tours, hikes, language courses and consultations. By making a booking, the customer accepts these Terms and Conditions.

2. Booking and Conclusion of Contract

The contract is concluded when the Provider confirms the booking. All offers are subject to change.

3. Prices and Payment

The prices stated at the time of booking apply. Unless expressly agreed otherwise, the full amount is due before the start of the booked service. The Provider reserves the right to refuse participation if payment is outstanding.

4. Cancellation and Rebooking

Cancellations and rebookings are free of charge up to 24 hours before the start of the booked service.

For later cancellations, rebookings or no-shows, the full amount is due. If a participant does not appear within 10 minutes of the agreed start time of a tour, language course or consultation, the service is deemed not to have been taken up and the full price will be charged. The Provider is not obliged to wait longer than 10 minutes for late participants.

Different cancellation terms may apply to private tours and individual guided tours. These will be communicated to the customer before booking and form part of the respective agreement.

5. Conduct of Tours and Hikes

Tours and hikes generally take place in all weather conditions, including rain, wind or snow. In the event of severe weather warnings, official orders or other safety risks, the Provider reserves the right to cancel, postpone or adjust tours at short notice.

Regular tours require a minimum of 2 participants. If this minimum is not reached, the tour will not take place. In this case, the Provider will cancel the tour no later than the evening before. Any payments already made will be refunded.

For private tours and individually arranged guided tours, the conditions agreed at the time of booking apply.

The Provider is entitled to change, shorten or terminate tours, especially hikes, for safety reasons. This applies in particular in the event of deteriorating weather, unsuitable trail conditions, health problems of individual participants, or if the group does not have the required physical fitness.

Any additional costs arising from a change or termination, for example for public transport, cable cars, ferries, taxis or other means of transport, shall be borne by the participants themselves.

6. Services and Additional Costs

Unless expressly stated otherwise, admission fees, food, drinks, tickets, ferries, cable cars, public transport and any other additional costs are not included in the price.

7. Participants’ Own Responsibility

Participation in tours, hikes and other activities is at the participant’s own risk. Each participant is responsible for assessing their own health and physical suitability for the booked service.

Participants are responsible for bringing suitable clothing, sturdy footwear, sufficient food and personal equipment. An appropriate level of physical fitness is required for hikes.

Each participant is responsible for having adequate health, accident, travel and liability insurance.

8. Language Courses and Consultations

Language courses and consultations serve exclusively for general information, orientation and support.

All information is provided to the best of the Provider’s knowledge and belief. However, no guarantee is given for its timeliness, completeness or accuracy. The Provider accepts no liability for decisions, actions, applications, bookings, financial losses or other consequences made or taken on the basis of the information provided.

The consultations offered do not constitute legal, tax, financial, insurance or immigration advice in the legal sense and do not replace professional advice from appropriately qualified bodies.

9. Liability

The Provider’s liability is limited to intent and gross negligence. In cases of slight negligence, the Provider is only liable for breaches of essential contractual obligations.

To the extent permitted by law, the Provider is not liable for accidents, injuries, health impairments, weather-related restrictions, or loss, theft or damage of personal belongings.

10. Complaints and Further Claims

The Provider owes the performance of the booked service, but not any particular personal result, learning outcome, travel outcome or subjectively expected experience.

Deviations due to weather, safety requirements, group dynamics, the physical capabilities of participants or other circumstances may require adjustments to the content, route, duration or schedule. Such changes do not give rise to claims for damages, substitute services or refunds, provided the change is made for objective or safety-related reasons.

There is no entitlement to a refund solely because the service did not meet the participant’s personal expectations.

Further claims against the Provider, in particular claims for damages, reimbursement of expenses or consequential damages, are excluded to the extent permitted by law, unless the Provider has acted intentionally or with gross negligence.

11. Exclusion of Participants

The Provider reserves the right to exclude participants from a tour, course or consultation if their behaviour significantly disrupts the activity, endangers others, or if they fail to follow the Provider’s instructions.

In this case, there is no entitlement to a refund of any amounts already paid.

12. Changes to the Offer

The Provider reserves the right to adjust content, routes, meeting points, times or procedures for organisational, operational or safety reasons, provided that the essential character of the booked service is maintained.

13. Final Provisions

Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

These Terms and Conditions are governed by the laws of the Kingdom of Norway. The place of jurisdiction is the Provider’s registered place of business (Bergen).
